Today, large-scale work is being
carried out in our country to create a favorable business environment, support
entrepreneurship, ensure free entrepreneurial activity, prevent interference
and illegal inspections by regulatory authorities in the business.
In accordance with the Decree of the
President of the Republic of Uzbekistan dated March 15, 2019 “On measures to radically
improve the system of protecting entrepreneurial activity and optimizing the activities
of the Prosecutor's Office”, from April 1, 2019, the coordination of
inspections of business entities and control over the legality of their conduct
by the regulatory authorities are carried out by the Commissioner under the
President of the Republic of Uzbekistan for the Protection of the Rights and Legitimate
Interests of Business Entities (the Business Ombudsman).
Conducting illegal inspections and
non-compliance with the requirements for conducting inspections of business
entities negatively affect the freedom of entrepreneurial activity and the
business environment in general.
In order to prevent such cases, the
Business Ombudsman conducts monitoring on an ongoing basis. The result of one
of the monitoring revealed cases of illegal inspections of the activities of
business entities by inspectors of the Andijan regional administration and
territorial divisions of the Inspection for Control over the Agro-Industrial
Complex under the Cabinet of Ministers of the Republic of Uzbekistan
(hereinafter referred to as the Inspection).
In particular, the employees of the
Andijan region department conducted inspections of the activities of the Khoshimjon
Oilasi and Karakaltak farms in the Ulugnor district of the Andijan region
without a corresponding order. The monitoring revealed that such illegal
inspections were carried out by 16 inspection officials.
Regulatory legal acts provide for
the prosecution of those guilty of violating the requirements of the
legislation on state control over the activities of business entities.
In accordance with Article 2412
of the Code of Administrative Liability, the employees of the office of the
Business Ombudsman have drawn up and sent to the court protocols on
administrative offenses against the officials of the Inspection who conducted
illegal inspections of the activities of entrepreneurs.
By a court decision, the
aforementioned inspections were declared illegal, and fines were imposed on the
offenders.
In the process of reforms aimed at
increasing the country's economic potential, it is important that all
regulatory bodies actively contribute to creating favorable conditions for the
development of entrepreneurship and small business, supporting entrepreneurs,
protecting their interests and rights, as well as ensuring the rule of law.
