In order to ensure prompt protection
of the rights of entrepreneurs, the Law "On the Commissioner under the
President of the Republic of Uzbekistan for the protection of the rights and
legitimate interests of business entities" (hereinafter - the Law)
provides for the consideration of the legal requirements of the Business
Ombudsman and his staff within 10 days.
However, there are government
officials who still violate the current legislation.
The Business Ombudsman was
approached by the head of the farm "Amu nasli Chorva", which operates
in the Amu Darya region of the Republic of Karakalpakstan, with a complaint
about the obstacles set in obtaining land for the development of animal
husbandry.
In order to provide quick, practical
assistance to farming, on the 5th of May 2020, the Business
Ombudsman sent a request to the khokimiyat of the Amu Darya region. The
execution of this letter was entrusted to the deputy khokim of the district for
agriculture and water management F. Sadullaev.
Despite the deadline set by the
Business Ombudsman for providing information on the appeal, the request F.
Sadullayev ignored.
State bodies and other
organizations, their officials are obliged to assist the Business Ombudsman in
his activities, to provide the documents, materials and other information
related to the rights and legal interests of business entities requested by
him, not later than ten days from the date of receipt of the request, if a
different period is not set.
In this regard, on the above facts
of violation of the law, the employees of the Office of the Business Ombudsman draw
up protocol on an administrative offense against the deputy khokim F.
Sadullayev on the facts of violations of the law.
As a result, by the decision of the
Amudarya district administrative court, the deputy khokim of the Amudarya
district F. Sadullaev was fined.
